ORDER AGREEMENT

When placing an order, you agree that any and all information given is accurate and complete.
All orders are subject to acceptance and product availability. If we are out of stock we will make every effort to connect you with one of our retail partners. Send all stock inquires to info@prairieunderground.com

All prices listed on are correct at the time of entering the information; we reserve the right to change prices of any product at any time. Prices do not include Washington state sales tax.

No contract for the sale of any product will exist between you and Prairie Underground until we accept your order and dispatch the product to you. We will confirm the acceptance by sending you an email.

A confirmation email will be sent to the email address given in your order form detailing the products ordered, payment method, cost (including applicable tax) and anticipated delivery date. You are responsible for reviewing the details on the confirmation email and should contact us as soon as possible if any details are incorrect.

If your order has is not available we will notify you via email and make every effort to connect you with another retailer to purchase the same item from them.

PAYMENT

Prairie Underground accepts Visa, Master Card, American Express and PayPal, or online gift certificate.

All credit and debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery. Your card will not be charged until the order has been filled.

GIFT CERTIFICATES

Online gift certificates are for use online only. Our online gift certificates cannot be used in any of the stores that carry our garments.

TAXES AND DUTIES

Residents of Washington will pay state tax on their purchase.

We ship internationally on a case-by-case basis. Please enquire with info@prairieunderground.com regarding international orders.

SHIPPING

Orders are usually processed within 3-5 business days, Monday through Friday, excluding holidays. Once the order is placed you will receive a confirmation e-mail. Once your order has been fulfilled you will receive an e-mail notification with updated shipping information.

Availability: Availability of products is not guaranteed. If you have ordered an item that is not available or that is delayed, we will notify you via email. Should we be unable to process your order in full due to an item/s being out of stock, you will only be charged for available items & your invoice & order confirmation will be updated accordingly.

UPS/Signature required: All order are shipped via USPS. Please let us know if you would like your order shipped through UPS, or with a signature required. Extra charges may apply. If you request no signature, Prairie Underground is not responsible in case of theft or loss.

Alaska and Hawaii: We do not currently offer flat rate shipping for Alaska and Hawaii. If you wish to ship to either of these states please contact info@prairieunderground.com There may be additional costs to ship to Alaska & Hawaii.

Canada: For orders shipping to Canada, there may be additional Duties & Customs fees which are paid by the customer at time of delivery. Prairie Underground does not cover these additional costs. Canadian orders are all final sale.

Shipping Delays: The delivery date stated in the confirmation email is approximate and beyond our control. Delivery delays may occur. Goods will be sent to the address given by you in your order.

In the event that your order does not arrive within the approximate delivery period we will do our best to assist in tracking your order. In the event of non-delivery we are unable to process a replacement until 10 business days following the original shipment date.

We will have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our control, including but not limited to acts of God, war, flood, fire, labor disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

ORDER CANCELLATIONS

If you have submitted your order and received a confirmation email from Prairie Underground.com, you can still cancel your order as long as it is before 3pm PST on the day you placed the order.

Please email your cancellation marked ‘CANCELLATION’ to info@prairieunderground.com and list your name, address, product ordered and order number on the email.
If your order shipped prior to cancellation, you will need to wait until you receive the product and then follow our Returns procedure.

Once we’ve heard from you that you wish to cancel an order, any sum debited to us from your credit or debit card will be re-credited to that credit or debit account within 30 days of your order minus $10 return shipping fee, provided the goods you return are in the same condition that they were in when delivered to you.

All items must be returned unused, in their original condition

REGISTRATION AND PASSWORD

When your register to use our site you are required to choose a username (email). Every time you log in, you will receive a new 6-digit code to enter as your password. This code can only be used once. It expires in 15 minutes. You accept responsibility for all actions taken under that username and password and agree to only purchase from Prairie Underground.com under your own username and password.

Keep your password safe and do not disclose it to anyone. If you think someone else might know it, you agree to change it.

You are not allowed to transfer or sell your username to anyone, nor permit anyone to use your username or password.

REFUND/RETURN POLICY

If you are not absolutely delighted with your Prairie Underground purchase, you can return any unworn, unwashed merchandise within 30 days of receipt. All items returned for a refund must have all original tags or packaging. After 30 days, all sales are FINAL. No price adjustments.

If you received a faulty or damaged item, you will be reimbursed for both delivery and return shipping charges. Please note that we do not accept liability for shipping loss or damage of returned goods.

We will process your return as soon as possible but please allow up to 14 days for your refund to be processed and up to two billing cycles for the return to appear on your credit card statement. If you submit your return through your account, please allow 2-3 days to approve. We only approve returns during the business week.

For purchases made with gift cards, refunds will be issued in the form of a new gift card.

We have the right to deny refunds and exchanges if the merchandise returned does not meet our return policy requirements.

We have taken every precaution to provide accurate images for products for sale on the site. However, due to a number of different factors such as internet browsers, monitor variations etc., we cannot be held responsible or liable for any differences in color between the image and the actual product.

Account Login – Returns

To start a return, go to your Account (https://account.prairieunderground.com)

1. Log in to your account (https://account.prairieunderground.com):
2. In the Email field, enter your email address, and then click Continue.
3. In your email account, open the email sent from our store and copy the six-digit verification code included in the email.
4. Go back to the online store, and then enter a six-digit verification code.
5. Click the order that you want to submit the return for.
6. If your order has more than one item, then select the items that you want to return.
7. Select a return reason and add a note for the store.
8. Click Request return.

If your return request is approved and requires shipping, then you will receive an email with shipping instructions and a new return shipping label. After the product is returned, you will receive a refund. We will refund the price of the garment, minus $10 for return shipping. Please note, our refunds do not cover original shipping fees.

EXCHANGE POLICY

We can exchange any unworn, unwashed merchandise within 30 days of receipt. We cover the $10 return fee for exchanges! All items returned for an exchange must have all original tags or packaging. After 30 days, all sales are FINAL. No price adjustments.

We will make every effort to accommodate an exchange request. However, our ability to process is based on product availability, which is not always guaranteed. We have the right to deny refunds and exchanges if the merchandise returned does not meet our return policy requirements.

To start an exchange, go to your Account (https://account.prairieunderground.com)

7. Select a return reason and add a note regarding your exchange (for example, name of exchange item, new size, or request a different color). Exchanges depend on stock availability.
8. Click Request return.

PRAIRIE UNDERGROUND PRODUCTS AND THIRD PARTY VENDORS

Website Errors

We do not accept liability for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed products and services at any time and without notice.

If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We are under no obligation to fulfill an order for a product that was advertised at an incorrect price.

In the event that you order an item and the price published on prairieunderground.com is incorrect for any reason, we will email you to inform you that we have not accepted your order, and that your order has been cancelled.

You will be advised of the correct price of the product and may re-order it if you wish. If you have already paid for the products with erroneous pricing, we will refund the full amount within 30 days of the date of order. If you choose to re-order at the correct price, a separate transaction will be posted to your credit card.

THIRD PARTY INFORMATION

We cannot be held responsible for material displayed on third party websites or any other written material. The only prices that apply for Prairie Underground products are those stated on PrairieUnderground.com. We cannot match prices stated on other websites or through any other third party.

The products sold on prairieunderground.com are provided for private domestic and consumer use only. We do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from prairieunderground.com.

WARRANTIES

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products.

These exclusions of express and implied warranties do not apply to the extent prohibited by local laws.

GENERAL INFORMATION & TERMS OF USE

Prairie Underground is a Limited Liability Company registered in Washington State.

Our office is located at 940 South Harney Street Seattle WA 98108. Most days we are not open to the public. Sign up on our mailing list to be contacted about events at our workshop.

Your contract for purchases made through Prairie Underground.com is with Prairie Underground, and all merchandise ordered by you is for your own private and domestic use.

You must be eighteen years old or older. If you are under eighteen, you may only use this site under the supervision of a parent or guardian. If you do not qualify, please do not use this site.

All details you provide to Prairie Underground for the purpose of ordering or purchasing merchandise must be true, accurate, current and complete. The credit or debit card you are using must be your own and there must be sufficient funds in your account to cover payment of the product(s) ordered.

You agree that email can be used as a means of communication.

LIMITATION OF LIABILITY

Prairie Underground’s total liability for any claim will not exceed the price of the products supplied by Prairie Underground to the customer. Prairie Underground will not be liable for any resulting customer loss, whether this arises from a breach of duty in contract or in any other way.

Prairie Underground cannot accept any liability for a failure to comply with specific instructions stated on our care and contents labeling or on the website. This statement does not affect customers’ rights.

We will not be liable, in contract, pre-contract or other representations for any economic losses, including without limitation loss of revenues, profits, contracts, business or anticipated savings or any loss of goodwill or reputation or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

ENTIRE AGREEMENT

These Terms and Conditions govern our relationship with you. You confirm that, in agreeing to accept the Terms and Conditions, you have not relied on any representation except where that representation has been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation.

The Terms and Conditions will be governed by and construed in accordance with the laws of the State of Washington without regard to any conflict of law provisions. You submit to the exclusive jurisdiction of the State and Federal courts of the State of Washington in King County.
